Alternative Dispute Resolution
An alternative to litigation is alternative dispute resolution which includes mediation. Mediation is a process by which a third party (the mediator) facilitates the negotiation of a dispute between two parties. Mediation is non-binding, which means that the mediator’s ideas are only recommendations to the parties, not directives. Mediation often takes place in conjunction with litigation in court as a vehicle for attempting to resolve conflicts prior to trial.
